Reasonable Accommodation/Grievance Procedure for Services and Facilities

East Hempfield Township is committed to providing services and facilities that are accessible to individuals with disabilities, and to making reasonable accommodations to individuals with disabilities, if they do not create undue hardship to the Township, in accordance with the requirements of the Americans with Disabilities Act (“ADA”).  The Township’s Employee Manual, effective date April 2021 governs employment-related complaints of disability discrimination.

Individuals requesting reasonable accommodations and those with grievances that the Township is not in compliance with the ADA should present their requests or grievances in writing to the Assistant Township Manager, Diane Garber, 1700 Nissley Road, Landisville PA 17538, telephone number 717-898-3100, extension 268 or via email dgarber@easthempfield.org.

Grievances and requests for reasonable accommodations may be presented orally or in writing.  If presented orally, the Township will reduce the matter to a writing, and ask the individual presenting the grievance to sign as verification as to the details thereof.  The Township will work with individuals requesting reasonable accommodations to determine whether there is a reasonable accommodation that may be made without undue hardship.  Reasonable accommodations may differ from those originally requested.

Grievance Procedure
Grievances should contain all relevant information so that the Township can investigate and reach a resolution of the matter.  Information should include:  the name, address, phone number, and email address of the grievant, and the location, date, and description of the issue, and any other relevant information. 

Grievances will be investigated upon receipt by the Assistant Township Manager, who will initiate the investigation.  Depending on the nature of the grievance, investigations may include: speaking with the grievant, speaking to others who may have information pertinent to the matter, reviewing the law and Township procedures, reviewing paperwork, and consulting others as needed.  Within thirty (30) days of receipt of the grievance, the Assistant Township Manager will provide the grievant in writing with the results of the investigation and any proposed resolution. 

If the grievant is not satisfied with the decision provided by the Assistant Township Manager, the grievant, within fifteen (15) days of the date of the Assistant Township Manager’s resolution, may appeal the grievance to the Township Manager, Cindy Schweitzer, 1700 Nissley Road, Landisville PA 17538, telephone number 717-898-3100, extension 241, or via email manager@easthempfield.org, who will review the resolution, meet with the grievant, and either:  (1) uphold the resolution of the Assistant Township Manager; (2) uphold the resolution of the Assistant Township Manager with changes; or (3) overturn the resolution of the Assistant Township Manager, and provide a new resolution for the matter.  The Township Manager will provide the grievant with a written final response within fifteen (15) days of receiving notice from the grievant.

Written grievances received and all written resolutions to them will be retained by the Township for three years from the date of the grievances.

Reasonable accommodations will be made for individuals with disabilities who need assistance with grievance process.
